Terms of Service
The short version
- The Keep is not a law firm and this is not legal advice. It reads documents you give it and reports what they say. What to do about your case is a conversation with a lawyer.
- Cancel whenever you like, from inside the app. You keep access to the end of the period you have already paid for.
- Fourteen days to change your mind. If your first subscription payment was within the last fourteen days, write to us and we will refund it in full.
- Your records are yours. Export them or delete them at any time. Cancelling does not delete anything.
- Recording laws are yours to follow. The app helps, but the responsibility is legally yours.
1This agreement
These terms are an agreement between you and Sigma Stronghold LLC, a Texas limited liability company, covering your use of The Keep — the app, the website at getthekeep.com, and everything we provide with them.
By creating an account or using The Keep, you agree to these terms. If you do not agree, do not use it. Our Privacy Policy forms part of this agreement.
2Not legal advice
The Keep reads documents you give it and reports what they say. It shows you deadlines that statutes set and tells you which statute. That is information about your own documents and about published law — it is not advice about your case, and it is not a substitute for a lawyer licensed in your state.
We work hard to make the app accurate and to show you the source of everything it tells you, so that you can check it. We cannot guarantee that it is correct, complete or current, and the law changes. Do not make a decision in your case on the strength of what this app tells you without talking to your attorney.
Nothing The Keep produces is certified, and no output of it is a legal filing.
3Who may use it
You must be at least 18 years old and able to enter a binding contract. The Keep is for parents, guardians, and the professionals they choose to share access with. It is not offered to children and children may not hold accounts.
Where the app is available is stated on our website and changes as we add states. Using it from a state we have not launched in does not mean the app understands that state’s law.
4Your account
- Give us accurate information and keep it current.
- Keep your password and your device secure. You are responsible for what happens under your account.
- Tell us promptly if you believe someone else has got into your account.
- One account is for one person. You may share a read-only view with an attorney or mediator; do not share your login.
5Plans and billing
The Keep has a free tier and paid subscriptions. Current prices are on our pricing page. A paid subscription covers every family unit on your account — it is not charged per child or per case.
- Subscriptions renew automatically at the end of each period — monthly or yearly, whichever you chose — until you cancel.
- You authorise us to charge your payment method for each renewal at the then-current price.
- Prices are exclusive of tax. Sales tax is added where the law requires it, based on where you are.
- Prices differ between our website and the app stores because Apple and Google take a share of anything sold inside an app. We pass that difference through rather than charging everyone the higher price.
- If we change prices, we will tell you at least 30 days before it affects a renewal, and you can cancel before it does.
- Failed payments. If a charge fails we will retry and let you know. If it keeps failing, your paid features stop and your account drops to the free tier. Your records are not deleted.
Usage beyond what your plan includes — extra calling numbers, recording minutes or text messages — is charged at the rates shown in the app at the time.
6Cancelling
Cancel at any time, from inside the app, without contacting us and without giving a reason.
- Cancelling stops the next renewal. It does not end the period you have already paid for — you keep paid access until that period runs out.
- After it runs out, your account moves to the free tier.
- Cancelling does not delete your records. They stay on your device and remain exportable. Deleting your account is a separate, deliberate action.
7Refunds
Fourteen days to change your mind
If you are within fourteen days of your first subscription payment, write to [email protected] and we will refund it in full. You do not have to explain why.
After that
Subscription fees are otherwise non-refundable, and cancelling part-way through a period does not produce a partial refund — you keep the access you paid for until the period ends.
When we will refund anyway
We are not going to hide behind the paragraph above when we are at fault. We will refund you if:
- You were charged after cancelling, or charged twice.
- The service was substantially unavailable for an extended period.
- You were charged for a renewal you did not intend and have not used the service since.
Refunds go back to the payment method you used, usually within five to ten business days.
8Bought through Apple or Google
If you subscribed inside the iOS or Android app, Apple or Google is the seller of record and their terms govern that transaction. That means:
- Manage or cancel the subscription in your Apple or Google account settings, not in ours. We cannot cancel it for you.
- Refunds for those purchases are handled by Apple or Google under their policies, not by us. The fourteen-day promise in section 7 applies to purchases made on our website.
9Acceptable use
The Keep exists to help you keep an accurate record of your own family’s situation. Do not use it:
- To harass, stalk, threaten or intimidate anyone, including the other parent.
- To fabricate, alter or backdate a record, or to create anything intended to mislead a court.
- To record anyone in a way that breaks the law where you are.
- To hold or transmit anyone’s information that you have no right to hold.
- To break into, overload, scrape or reverse-engineer the service.
- To resell or rebrand the service as your own.
We may suspend or close an account that does these things.
10Recording and consent
By using the recording features you confirm that you have whatever consent the law requires. An unlawful recording is not merely inadmissible; in some states making one is a criminal offence. If you are not certain, ask your attorney before you record.
11Your content, and your records
Everything you put into The Keep remains yours. We claim no ownership of your documents, entries, recordings or messages.
You grant us only the permission we need to run the service for you: to store, process and display your content back to you, to transmit it to people you choose to share it with, and to process it as the Privacy Policy describes. We do not use your content to train AI models and we do not sell it.
You are responsible for keeping your own copies. Export your record regularly. See the Privacy Policy for what is stored where, and note that records held only on your device cannot be recovered by us if you lose it.
12Availability and changes
We aim to keep The Keep running, but we do not promise uninterrupted service. We may change, add or remove features. If we remove something you rely on, or make a change that materially reduces what you are paying for, we will tell you beforehand and you may cancel and receive a refund of the unused portion of your term.
13Disclaimers
The Keep is provided “as is”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
In particular, and without limiting section 2: we do not warrant that the app’s reading of your order is correct, that any deadline it calculates is right, or that any record it produces will be admitted by a court or will help your case. Check what it tells you against your own documents and with your own attorney.
14Limitation of liability
To the fullest extent the law allows, Sigma Stronghold LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or any outcome in your legal case.
Our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose.
Some states do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.
15Ending this agreement
You may stop using The Keep and delete your account at any time. We may suspend or close an account that breaches these terms, that we are required to close by law, or that is being used to harm someone. Where circumstances allow it, we will give you notice and the chance to export your records first.
Sections 2, 11, 13, 14 and 16 survive the end of this agreement.
16Governing law and disputes
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Texas, and you and we each consent to that jurisdiction.
Before filing anything, write to [email protected] and describe the problem. Most things are resolvable in an email, and we would rather fix it than litigate it.
If any provision of these terms is held unenforceable, the rest stays in force.
